The Election Commission has decided to move ahead only after both the groups send replies on the CPN
(Maoist) dispute. The commission has already written to both Oli and Dahal-Nepal. Spokesperson Raj Kumar
Shrestha informed that further process will be taken forward after receiving the reply to the letter. According to
Spokesperson Shrestha, correspondence has been sent to both the parties as per the Political Parties Act. The
Dahal-Nepal side has been asked to respond within seven days. Oli’s side has not been given a deadline. In a
letter sent to the Dahal-Nepal faction, the commission has informed that action can be taken as per paragraph
9 only if it comes in accordance with Article 44 of the Political Parties Act 2073 BS. In the letter sent to Oli’s
party, it is mentioned that the commission has decided to provide information about Article 43 of the Political
Parties Act 2073 BS. The commission has stated that different letters have been sent considering the
seriousness of the issue. The Dahal-Nepal faction had submitted a petition to the commission on January 22,
23 and 24. The Oli faction had filed the petition on April 22 and 23. The Dahal-Nepal faction has registered a
letter with the Commission with the decision of the Standing Committee meeting on April 20, the decision of
the Central Committee on August 26 and the decision on April 25. The Oli faction has registered a letter with
the commission with the nomination of 1199 central members on April 22 and the amendment of the
constitution and the decision of the central committee meeting on April 25. The Dahal-Nepal faction has
registered a letter with the party claiming the party’s name, flag and election symbol. Only the Oli faction has
informed the commission about the expansion of the Central Committee and the amendment of the
constitution.
